WHEREAS, a proposed local law was introduced to amend Chapter 185, Section 13, Subsection A and Chapter 185, Attachment 1 concerning two-family dwellings in the two-family residence R-2A District; and
WHEREAS, in June 2022, the Village initiated a zoning analysis of the R-2A District in response to inquiries about the potential for increased density through subdivision of large lots in the R-2A District, and to identify revisions to the Village Zoning Code to address any concerns about such development; and
WHEREAS, based on the zoning analysis, the Village proposes to revise Village Code §185-13.A to specify that future two-family homes must face and have their entire required lot width along Bedford Road, even in the case of a corner lot which has two front yards; and
WHEREAS, the proposed local law is intended to ensure that two-family development is focused on Bedford Road, a two-lane arterial road, rather than fronting along narrower residential side streets; and
WHEREAS, the proposed local law is an Unlisted Action pursuant to the State Environmental Quality Review Act (“SEQRA”) and the Village Board of Trustees is the sole approval authority and therefore serves as Lead Agency; and
WHEREAS, the Village Board of Trustees has reviewed the SEQRA Full Environmental Assessment Form Parts 1 and 2; and
WHEREAS, on August 8, 2022 the Board of Trustees directed referral of the local law pursuant to the General Municipal Law and Westchester County Administrative Code to the Westchester County Planning Board; such referral was made on August 9, 2022 and a response dated August 19, 2022 was received from Westchester County Planning; and
WHEREAS, on August 8, 2022 the Village of Board of Trustees referred the proposed local law to the Village Planning Commission for report and recommendation and comments dated September 16, 2022 were received by the Village Board of Trustees; and
WHEREAS, a duly noticed public hearing on the proposed local law was held on September 29, 2022 at Village Hall, 80 Wheeler Avenue, Pleasantville, New York, at which time all those interested were given an opportunity to be heard, and the public hearing was closed on October 13, 2022; and
WHEREAS, the Village Board of Trustees is fully familiar with the proposed local law.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Trustees of the Village of Pleasantville, in accordance with SEQRA and after taking a “hard look” at each of the relevant areas of environmental concern through review of the EAF and all associated materials prepared in connection with the Proposed Action hereby adopts the attached Negative Declaration for the proposed local law finding that the adoption of the local law will not result in any significant adverse environmental impacts for the reasons set forth in the Negative Declaration,
BE IT FURTHER RESOLVED, that the Board of Trustees of the Village of Pleasantville hereby adopts Introductory Local Law 8 of 2022 which upon its passage will become Local Law 8 of 2022 to amend Chapter 185, Section 13 and Chapter 185, Attachment 1 of the Code of the Village of Pleasantville regarding two-family dwellings in the two-family residence R-2A District
